RANCHI, India, June 23 -- Jharkhand High Court issued the following order on May 27:

1. The petitioner is an accused for the offences punishable under Sections 364, 302, 201/34 of the Indian Penal Code.

2. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has not committed any offence as alleged in the F.I.R. He submits that even on perusal of the written report, it is evident that three accused persons including the petitioner have been implicated in this case merely on the basis of suspicion and similarly situated co-accused person, namely, Pankaj Kumar @ Pankaj Saw has already been granted regular bail by a co-ordinate Bench of this Court vide order dated 22.10.2024 passed in B.A. No. 7571 of 2024. He further submits that there is no eye witness to the occurrence and the police has also not collected any cogent material against the petitioner to connect him with the alleged offence. The petitioner is in judicial custody in connection with the present case since 28.03.2025. Since, the case of the petitioner is similarly situated to co-accused namely Pankaj Kumar @ Pankaj Saw, his prayer for regular bail may kindly be allowed.

Though learned APP opposes the petitioner's prayer for regular bail, however, on replying to the query of the Court, he submits that there is no eye witness to the occurrence and the petitioner has been implicated in this case on the basis of suspicion raised by the informant as mentioned in the FIR.

Having heard the learned counsel for the parties and considering the materials available on record as well as the fact that similarly situated co-accused namely Pankaj Kumar @ Pankaj Saw has already been granted the privilege of regular bail by a coordinate Bench of this Court, I am inclined to enlarge the petitioner on bail.

5. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Chatra in connection with Lawalong P.S. Case No.10 of 2024.
