RANCHI, India, Dec. 23 -- Jharkhand High Court issued the following order on Nov. 24:
Heard the learned counsel for the respective sides.
This appeal is directed against the order dated 18.09.2025 passed in B.P. No. 562 of 2025 by the learned Additional Sessions Judge-II, Chatra in connection with Kunda PS Case No. 46 of 2021, whereby and whereunder, the prayer for bail of the appellant has been rejected.
It has been alleged that on the basis of a secret information a raid was conducted by the police and several persons who had assembled had started firing and ultimately they had fled away.
Submission has been advanced by the learned counsel for the appellant that the appellant has been implicated on the confessional statement of the coaccused. It has been submitted that the appellant is in custody since 18.07.2025 and one of the co-accused Chandan Ganjhu has been granted bail by a co-ordinate Bench of this Court in Criminal Appeal (DB) No. 359 of 2025.
Learned Spl.P.P has opposed the prayer for bail of the appellant.
On consideration of the manner of implication of the appellant and the fact that one of the co-accused has been granted bail by a co-ordinate Bench of this Court as noted above, we while setting aside the order dated 18.09.2025 passed in B.P. No. 562 of 2025 by the learned Additional Sessions Judge-II, Chatra in connection with Kunda PS Case No. 46 of 2021, direct the appellant be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Chatra in connection with Kunda PS Case No. 46 of 2021.
This appeal is allowed.
