Heard the learned counsel for the respective parties.

This application has been preferred by the appellants for condoning a delay of 102 days in filing the appeal.

Having been satisfied with the reasons assigned in this application, the delay of 102 days which had occurred in filing this appeal is condoned and this I.A. is allowed and disposed of.

Heard Mr. Gaurav Raj, the learned AC to AAG-II and Mr. Kashish Tiwari, the learned counsel appearing for the respondents.

This appeal is directed against the order dated 08.12.2023, passed by the learned Single Judge in IA No. 9883 of 2023. In the said writ application being WP(S) No. 1648 of 2023, a prayer was made for directing upon the respondents-State authorities as to why the monthly remuneration of the writ petitioners have been withheld for the month of December, 2022 and January, 2023. The other prayers which have been made are all consequential to the stoppage of monthly remuneration to the writ petitioners.

It has been submitted by Mr. Gaurav Raj, the learned AC to AAG-II that the work which was taken from the writ petitioners were being outsourced. It has been stated by Mr. Gaurav Raj, the learned AC to AAG-II that the writ petitioners have also preferred a separate writ application being WP(S) No. 2045 of 2023 which was with a prayer for regularization of their services. It has been submitted that WP(S) No. 1648 of 2023 is pending. It has been submitted that the monthly remuneration is being regularly paid to the writ petitioners.

The learned counsel appearing for the respondents has submitted that the present appeal is against an interim order passed by the learned Single Judge in WP(S) No. 1648 of 2023 and since the prayer in the writ application is with respect to the payment of remuneration and the same is being already paid to the writ petitioners the present appeal is liable to the dismissed.

It has been submitted by the learned counsel for the respective parties that so far as WP(S) No. 2045 of 2023 is concerned, the same has already been disposed of by the learned Single Judge with certain directions including formation of a Committee. The said writ application was with respect to regularization of the writ petitioners. So far as the impugned order dated 08.12.2023, passed in WP(S) No. 1648 of 2023 is concerned, the same is an interim order passed by the learned Single Judge and since the said writ application is pending and the monthly remuneration is being extended to the writ petitioners as submitted by Mr. Gaurav Raj, the learned AC to AAG-II, we are not inclined to entertain this appeal and interfere with the order dated 08.12.2023 passed in WP(S) No. 1648 of 2023.

Consequently, this appeal stands disposed of.

Pending I.A., if any, stands closed.
