RANCHI, India, June 8 -- Jharkhand High Court issued the following order on May 8:
1. The learned counsel for the appellant submits that this appeal has been preferred on the ground that no evidence has been brought by the claimants to establish that the business of milk has been closed or the cows have been sold and the cows are still there. He submits that loss has not been traced and he further submits that the other grounds have also been taken.
. I. A. No.3946 of 2024 has been filed for staying the Execution Case No.9 of 2024. He submits that pursuant to that the petition has been filed by the decree holder and the Tribunal has passed the order on 28.4.2025 for attachment of the bank account of the appellant herein and the matter has been posted on 4.5.2025 for compliance of the said order. He submits that in this background, the I.A has been filed.
3. In view of above facts and considering the hardship of the claimants the insurance company is directed to deposit the entire awarded amount along with the interest before the learned Tribunal. Out of the deposited amount, 50% shall be released in favour of the claimants by the learned Tribunal on proper verification and the rest of the amount shall be kept intact which will be subject to the result of the present appeal.
4. Issue notice upon the O.P.Nos.1 to 4 by registered post with A/d as well as under ordinary process at the present and correct address for which requisites etc must be filed within one week after summer vacation.
5. The O.Ps are kept at liberty to file proper petition for modification of this order.
6. The Execution Case No.9 of 2024 as well as the order dated 28.04.2025 are hereby stayed.
7. The instant IA stands allowed and disposed of.
