RANCHI, India, June 11 -- Jharkhand High Court issued the following order on May 15:
1. Heard the parties.
2. Petitioner has been made accused in connection with Kamdara P.S. Case No. 14 of 2025 for the offences registered under Sections 310(4), 310(5) of the Bharatiya Nyaya Sanhita (BNS), 2023 and under Sections 25(1-B)a, 26, 35 of the Arms Act and under Section 17 of C.L.A. Act, pending in the court of learned Additional Chief Judicial Magistrate, Gumla.
3. From perusal of record, it transpires that there is allegation against this petitioner that two co-accused persons Durga Singh and Ram Kumar Singh got apprehended along with petitioner and from possession of Durga Singh one country made loaded pistol, whereas from possession of co-accused Ram Kumar Singh two cartridges and from this petitioner leaflet of PLFI got recovered. Petitioner is stated to be in judicial custody since 13.03.2025.
4. Learned counsel for the petitioner very fairly submitted that the petitioner is having two cases to his credit and petitioner is no more required for further investigation and charge sheet has already been submitted.
5. Learned A.P.P. for the State opposes the prayer of bail on the premise that petitioner is having criminal antecedent and he is a member of PLFI.
6. Considering the fact that alleged recovery has already been effected and charge sheet has been submitted and petitioner is no more required for further investigation, the petitioner named above, is directed to be released on bail on furnishing bail bonds of Rs. 25,000/- (Rupees twenty five thousand), with two sureties of the like amount each, to the satisfaction of learned Additional Chief Judicial Magistrate, Gumla in connection with Kamdara P.S. Case No. 14 of 2025.
