RANCHI, India, Nov. 30 -- Jharkhand High Court issued the following order on Oct. 29:
1. Heard learned counsel for the parties.
2. Learned counsel for the petitioner has submitted that the present transfer petition has been filed under section 24 of the Code of Civil Procedure for transfer of Original Suit No.152 of 2024 to the court of learned Principal Judge, Family Court, Ranchi from the court of learned Principal Judge, Family Court, Ramgarh. The Original Suit No.152 of 2024 has been filed by the opposite party against the present petitioner (wife) for the decree of nullity of the marriage under section 11of Hindu Marriage Act, 1955.
3. Learned counsel for the petitioner has submitted that the marriage of the petitioner was solemnized with the opposite party on 04.08.2023 in accordance with Hindu Rites and Customs. After two months of their marriage, the opposite party(husband) and his family members started misbehaving and harassing the petitioner. It is further submitted that petitioner has no knowledge about the case rather she came to know about the case after receiving a notice from the Principle Judge, Family Court, Ramgarh, which was filed by her husband for nullity of marriage under section 11 of Hindu Marriage Act. The petitioner has no any source of income and she is now living at her paternal house on her parent's expenses.

It is further submitted that petitioner is anyhow maintaining and looking after herself, so she could not bear additional cost of litigation by attending the Court of Principal Judge, Family Court at Ramgarh, which is more than 50 kms away from her parental house and therefore this Original Suit No.152 of 2024, pending before the Principal Judge, Family Court, Ramgarh be transferred to the court of learned Principal Judge, Family Court, Ranchi.
5. Considering the overall aspects of the case and the submission on behalf of the petitioner, I feel inclined, in the ends of justice, to allow the prayer of the petitioner.
6. Accordingly, the proceeding of Original Matrimonial Suit No.152 of 2024, pending before the court of Principal Judge, Family Court, Ramgarh is hereby transferred to the court of learned Principal Judge, Family Court, Ranchi.
7. Accordingly, the present transfer petition stands disposed of.
