RANCHI, India, Jan. 3 -- Jharkhand High Court issued the following order on Dec. 2:
Heard Ms. Kehkashan Afsheen, learned counsel for the appellant and learned A.P.P. for the State.
This interlocutory application has been preferred by the appellant for condoning a delay of 30 days in filing the appeal.
Having been satisfied with the reasons assigned in the instant application, the same is allowed and the delay of 30 days in filing the appeal is, hereby, condoned.
I.A. No. 13538 of 2025 stands disposed of.
Criminal Appeal (D.B.) No. 1419 of 2025
This appeal is directed against the order dated 15.07.2025 passed by the learned Additional Sessions Judge-III, Giridih in M.C.A. No. 1378 of 2025, in connection with Bhelwaghati P.S. Case No. 07 of 2020, corresponding to S.T. Case No. 214 of 2025, whereby and whereunder, the prayer for bail of the appellant has been rejected.
It has been alleged that on a secret information a search operation was conducted by the Police personnel and the C.R.P.F. and in course of search near the bank of river under Bhelwaghati P.S. 185 pieces of gelatins and 410 pieces of detonators were recovered and seized.
Submission has been advanced by the learned counsel for the appellant that the appellant has been implicated only on the basis of suspicion. It has been submitted that the Investigating Agency has failed to bring on record as to how the appellant was involved in the concealment of the explosive substances.
Learned A.P.P. has opposed the prayer for bail of the appellant and has submitted that the appellant has got several criminal antecedents.
Regard being had to the manner of implication of the appellant, we while setting aside the order dated 15.07.2025 passed by the learned Additional Sessions Judge-III, Giridih in M.C.A. No. 1378 of 2025, in connection with Bhelwaghati P.S. Case No. 07 of 2020, corresponding to S.T. Case No. 214 of 2025, direct that the appellant be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-III, Giridih in connection with Bhelwaghati P.S. Case No. 07 of 2020, corresponding to S.T. Case No. 214 of 2025.
This appeal stands allowed.
