RANCHI, India, Feb. 11 -- Jharkhand High Court issued the following order on Jan. 12:
1. Heard the parties.
2. In this writ petition, the petitioner has prayed for following reliefs:-
" 1. For issuance of an appropriate writ(s), order(s), direction(s) commanding upon the concerned respondents to pay the arrears of salary of difference salary from 13.04.2015 to 31.12.2023 of Rs.29,40,152/- which has been duly calculated by the respondent authorities, but the same has not been paid to the petitioner till date, along with statutory interest.
AND
The petitioner prays for issuance of an appropriate writ(s), order(s), direction(s) commanding upon the concerned respondents to pay the arrears of pension as well as current pension to the petitioner by counting her past service also, as the petitioner has retired on 31.12.2023 from the post of A.N.M., Community Health Centre, Sundarpahari."
3. Learned counsel appearing on behalf of the respondents submits that if the petitioner files a fresh representation, before the Civil Surgeon-cum-Chief Medical Officer, Godda -respondent No.4, her case will be considered and an appropriate order will be passed as per law.
4. Considering the submission of the parties, I direct the petitioner to file a fresh representation within four weeks before the Civil Surgeon-cum-Chief Medical Officer, Godda -respondent No.4. On receipt of the said representation, the case of the petitioner will be considered within six weeks and if it is necessary to place the case before any committee or any authority, the same should be placed during the said period.
5. If it is found that the petitioner is entitled for any amount, the same will be granted within four weeks thereafter.
6. If any part of the claim of the petitioner is rejected, the reasons thereof should be communicated to the petitioner within the aforesaid period.
7. With the aforesaid observations, this writ petition stands disposed of.
