RANCHI, India, June 10 -- Jharkhand High Court issued the following order on May 13:
1. Heard the parties.
2. Petitioner has been made accused in connection with Gumla P.S. Case No. 101 of 2025 for the offences registered under Sections 21(a), 22(a) and 29 of the NDPS Act, pending in the court of learned Sessions Judge, Gumla.
3. There is allegation that the petitioner and one co-accused person were having 0.80 gm of brown sugar and police has seized the same on the information received by them.
4. Learned counsel for the petitioner submitted that petitioner is in judicial custody since 20.03.2005 and is having clean antecedent.
5. Learned Spl.P.P. for the State opposed the prayer of bail of the petitioner on the premise that this petitioner along with other coaccused person were involved in trade of narcotic substance.
6. Record reveals that 0.80 gm of brown sugar filled in cigarette which was on the ground was seized by police official. Record does not reveal criminal antecedent of this petitioner. Needless to say that small quantity is 5 gm as far as brown sugar is concerned.
7. Considering the judicial detention of the petitioner, this Court is inclined to grant bail of this petitioner.
8. In the aforesaid facts and circumstances of the case, the petitioner named above, is directed to be released on bail on furnishing bail bonds of Rs. 25,000/- (Rupees twenty five thousand), with two sureties of the like amount each, to the satisfaction of learned Sessions Judge, Gumla in connection with Gumla P.S. Case No. 101 of 2025.
