RANCHI, India, Feb. 8 -- Jharkhand High Court issued the following order on Jan. 8:
1. Heard the parties. 2. In this writ petition, the petitioner has prayed for following reliefs:-
"(i) For a direction commanding upon the respondents to revise the pension of the petitioner as per 7th PRC effective from 01.01.2016.
(ii) To also direct the respondents to pay penal/statutory interest on Provident Fund (PF) amount with effect from February, 2010 to October, 2025, as the respondents kept this amount with them and paid the same only on the direction of this Hon'ble Court though the petitioner retired on 31.01.2009.
(iii) To also direct the respondents to pay difference of salary on account of 6th PRC with effect from 01.01.2006 to 31.07.2009, the day when the petitioner retired from the post of Senior Accounts Clerk, Waterways Division, Garhwa.
(iv) To direct the respondents to grant the benefit of 3rd MACP to the petitioner as the petitioner was appointed on 01.01.1973 and retired on 31.07.2009 after completion of 37 years of service without any promotion.
(v) To also direct the respondents to pay interest @12 per annum on all admissible dues payable to the petitioner with effect from the date the same were payable till the date of actual payment."
3. Learned counsel appearing on behalf of the respondents submits that if the petitioner files a fresh representation, before the Executive Engineer, the Waterways Division, Garhwa -respondent No.2, his case will be considered and an appropriate order will be passed as per law.
4. Considering the submission of the parties, I direct the petitioner to file a fresh representation within four weeks before the Executive Engineer, the Waterways Division, Garhwa - respondent No.2. On receipt of the said representation, the case of the petitioner will be considered within six weeks and if it is necessary to place the case before any committee or any authority, the same should be placed during the said period.
5. If it is found that the petitioner is entitled for any benefits, the same will be granted within four weeks thereafter.
6. If any part of the claim of the petitioner is rejected, the reasons should be communicated to the petitioner within the aforesaid period.
7. With the aforesaid observations, this writ petition stands disposed of.
