Heard the parties.
This criminal miscellaneous petition has been filed at the instance of the petitioner for restoration of A.B.A. No. 7348 of 2023 to its original file.
Learned counsel for the petitioner submits that A.B.A. No. 7348 of 2023 was dismissed for non-compliance of the order of this Court dated 05.10.2023 to file a supplementary affidavit. It is next submitted that due to inadvertence, the said order could not be complied with within the stipulated time but now the petitioner has filed the said supplementary affidavit along with this instant criminal miscellaneous petition. It is next submitted that the petitioner has very good grounds to agitate in the said A.B.A. No. 7348 of 2023 and unless A.B.A. No. 7348 of 2023 is restored to its original file, the petitioner will be highly prejudiced. Hence, it is submitted that the A.B.A. No. 7348 of 2023 be restored to its original file.
Considering the aforesaid submission of the learned counsel for the petitioner, A.B.A. No. 7348 of 2023 is restored to its original file to the stage at which, it was before its dismissal.
List A.B.A. No. 7348 of 2023 under the appropriate heading after a week.
