RANCHI, India, Nov. 2 -- Jharkhand High Court issued the following order on Oct. 6:

1. Heard learned counsel appearing for the petitioner and learned counsel appearing for the State.

2. The petitioner is apprehending his arrest in connection with Gamharia P.S. Case No.70 of 2024, registered for the offence under Sections 406/ 419/420 of the Indian Penal Code, pending in the Court of the learned Chief Judicial Magistrate at Seraikella.

3. Learned counsel appearing for the petitioner submits that the petitioner has taken friendly loan of Rs.4,20,350/- from the informant. He further submits that intention of the petitioner was very much there to return the said amount and he has already returned sum of Rs.1,20,000/- and that has also been disclosed in the FIR. He then submits that the petitioner has got no criminal antecedent, as disclosed in paragraph 15 of this application. He next submits that for recovery of the amount, the FIR has been registered.

4. Learned counsel appearing for the State opposed the prayer and submits that the allegations are there of taking of the amount and not returning the same.

5. In the FIR itself, it has been disclosed that Rs.1,20,000/- has been returned by the petitioner to the informant and for recovery of the remaining amount, the FIR has been lodged and the petitioner has got no criminal antecedent. In the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner.

Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he will be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate at Seraikella in connection with Gamharia P.S. Case No.70 of 2024, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
