RANCHI, India, Jan. 13 -- Jharkhand High Court issued the following order on Dec. 13:

I.A. No. 16050 of 2025

1. Heard Mr. Rakesh Kumar, learned counsel for the appellant and learned A.P.P.

2. This application has been preferred by the appellant for condonation of delay of 30 days in preferring the appeal.

3. Having been satisfied with the reasons assigned in the instant application, the same is allowed and the delay of 30 days in preferring the appeal is hereby condoned.

4. I.A. No. 16050 of 2025 stands disposed of. Cr. Appeal (DB) No. 1527 of 2025

5. This appeal is directed against the order dated 18.08.2025 passed by the learned Additional Sessions Judge-I-cum-Spl. Judge, Gumla in B.P. No. 501 of 2025, arising out of Gumla (Ghaghra) AHTU P.S. Case No. 18/2021, whereby and whereunder, the prayer for bail of the appellant has been rejected.

6. It has been alleged that about 10 years prior to the institution of first information, the daughter of the informant was taken away and sold by Kalas Devi and Jitiya Oraon.

7. It has been submitted by the learned counsel for the appellant that the appellant is not named in the first information report and in course of investigation, he has been implicated in this case on account of disclosure made by Jitiya Oraon. Learned counsel submits that save and except the confession of Jitiya Oraon, there is no material which would show any involvement of appellant in trafficking the daughter of the informant. Learned counsel submits that appellant is in custody since 17.12.2024. Learned counsel submits that Jitiya Oraon has already been granted bail by the court below.

8. Learned A.P.P. has opposed the prayer for bail of the appellant.

9. Regard being had to the aforesaid fact, we, while setting aside the order dated 18.08.2025 passed by the learned Additional Sessions Judge-I-cum-Spl. Judge, Gumla in B.P. No. 501/2025, arising out of Gumla (Ghaghra) AHTU P.S. Case No. 18/2021, direct that the appellant be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I-cum-Spl. Judge, Gumla in connection with Gumla (Ghaghra) AHTU P.S. Case No. 18/2021, Spl. G.R. No. 31 of 2025 (S.T. No. 62 of 2025).

10. This appeal is allowed.
