RANCHI, India, July 22 -- Jharkhand High Court issued the following order on June 23:
1. In the present writ application prayer has been made for direction upon the respondents to consider the application of petitioners made for Transfer in terms of Circular issued by the Primary Education and Literacy Department vide Notification No. 434 dated 01.03.2016 and Notification No. 1556 dated 08.06.2022 since vide office order No. 872 dated 11.07.2024 and Office Order No. 992 dated 02.08.2024; since the benefits of transfer have already been extended to the similarly situated employees/ teachers.
2. At the outset, learned counsel for the petitioners submits that instant application may be disposed of by giving liberty to the petitioners to approach respondent No. 2, so that their grievances raised in the writ application can be redressed.
3. Though counter-affidavit has been filed, however, learned counsel for the respondents submits that since the petitioners have prayed for giving liberty to approach the respondents for ventilating their grievances, they may be directed to file individual fresh representations before the respondent No. 2, who shall decide the case in accordance with law.
4. Having regard to the aforesaid facts and circumstances of the case and the limited submissions of the rival parties, the instant writ application is hereby disposed of by directing the respective petitioners to file fresh representations before the respondent No. 2. The moment the concerned respondent will receive any such representation(s), he shall take decision in accordance with law and applicable rules and regulations within a period of four months from the date of receipt of such representation(s).
5. As a result, the instant writ application stands disposed of.
