RANCHI, India, Oct. 27 -- Jharkhand High Court issued the following order on Sept. 26:
1. Heard learned counsels for petitioners and for State.
2. The petitioners are apprehending their arrest in connection with Manika PS Case No.47 of 2025, for offence registered under section 317(5) of BNS, 2023 and Section 47(a) 47(b) and 55 of Excise Act, pending in court of learned A.C.J.M., Latehar.
3. Learned counsel for petitioners submits that name of petitioners have come only on the confessional statement and the petitioners have got no criminal antecedent and liquor in question has been recovered from forest and the petitioners are nothing to do with the said liquor.
4. Learned State counsel opposes prayer and submits that the allegations are there of dealing with the English liquor.
5. Considering that name of the petitioners have come only on the confessional statement and the petitioners have got no criminal antecedent, I am inclined to grant anticipatory bail to petitioners.
6. Accordingly, petitioners, above named, are hereby directed to surrender before learned court within three weeks from today, and in event of their surrender/arrest, petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned A.C.J.M., Latehar, in connection with Manika PS Case No.47 of 2025, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
