RANCHI, India, Nov. 2 -- Jharkhand High Court issued the following order on Oct. 6:
1. Heard learned counsel appearing for the petitioners and learned counsel appearing for the State.
2. The petitioners are apprehending their arrest in connection with Telaiya P.S. Case No.299 of 2024, registered for the offence under Sections 272, 274, 275, 292 of the Bharatiya Nyaya Sanhita, 2023 and Section 47(a)(f) of Excise Act, pending in the Court of the learned Additional Chief Judicial Magistrate, Koderma.
3. Learned counsel appearing for the petitioners submits that the petitioners have got no criminal antecedents, as disclosed in paragraph 13 of this application. He further submits that the allegations are made that 80 liters of Mahuwa liquor and 3000 Kg of Jawa Mahuwa was recovered from the forest area. He then submits that nothing has been recovered from the possession of the petitioners. He next submits that only on the basis of disclosure made by some of the villagers, the name of the petitioners has occurred in the FIR.
4. Learned counsel appearing for the State opposed the prayer and submits that 80 liters of Mahuwa liquor and 3000 Kg of Jawa Mahuwa was recovered from the forest area.
5. Considering that the petitioners have got no criminal antecedents and even nothing has been recovered from the possession of the petitioners and unknown persons have taken the name of the petitioners and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioners.
6. Accordingly, the above-named petitioners are directed to surrender before the learned Court within three weeks from today and in the event of their arrest or surrender, they will be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Koderma in connection with Telaiya P.S. Case No.299 of 2024, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
