RANCHI, India, June 8 -- Jharkhand High Court issued the following order on May 8:

Heard Mr. Sheo Kumar Singh, learned counsel for the appellant and Mr. Shree Prakash Jha, learned A.P.P. for the State.

This appeal is directed against the order dated 27.01.2025 passed by the learned Additional Sessions Judge-V, Palamau at Daltonganj in B.P. No. 03/2025, arising out of Nawa Bazar P.S. Case No. 77 of 2024, whereby and whereunder the prayer for bail of the appellant has been rejected.

It has been alleged that the granddaughter of the informant was kidnapped and suspicion was raised upon the present appellant and one Raju Bhuiyan.

Submission has been advanced by the learned counsel for the appellant that the appellant is alleged to have facilitated the abduction and in fact the victim was recovered from the custody of Raju Bhuiyan. It has further been submitted that the appellant is in custody since 03.11.2024.

Learned A.P.P. has opposed the prayer for bail of the appellant.

Regard being had to the fact that the victim was recovered from the custody of Raju Bhuiyan, we while setting aside the order dated 27.01.2025 passed by the learned Additional Sessions Judge-V, Palamau at Daltonganj in B.P. No. 03/2025, arising out of Nawa Bazar P.S. Case No. 77 of 2024, direct that the appellant be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each, to the satisfaction of learned J.M. 1st Class, Palamau in connection with Nawa Bazar P.S. Case No. 77 of 2024.

This appeal is allowed.
