RANCHI, India, March 8 -- Jharkhand High Court issued the following order on Feb. 6:
1. This civil review has been filed by the State to review the Award dated 13.07.2024 passed in WP(S) No. 1298 of 2023 passed in the National Lok Adalat.
2. Award which has been arrived at settlement in National Lok Adalat cannot be a subject matter of review jurisdiction as no review under section 114 of the Code of Civil Procedure read with Order 47 of the Code of Civil Procedure is maintainable against the same.
3. Further in "Dilip Mehta vs. Rakesh Gupta and Others" reported in 2025 SCC OnLine SC 2737, the Hon'ble Supreme Court has held that if a person is aggrieved by the Award, the only remedy is to invoke the supervisory jurisdiction of the High Court. The supervisory jurisdiction of the High Court is in terms of Article 227 of the Constitution of India.
4. In this case the petitioner has filed review application to review the Award dated 13.07.2024 passed in WP(S) No. 1298 of 2023 passed in the National Lok Adalat, which is not maintainable.
5. Thus, this review petition is dismissed as not maintainable.
