RANCHI, India, May 29 -- Jharkhand High Court issued the following order on April 29:
1. Heard the parties.
2. In this writ petition, the petitioner has prayed for following relief(s):-
(i) For direction upon the respondent authorities to forthwith register Bharat Stage (BS)-IV vehicles having sold before 1.4.2020 but the respondent No. 5 has refused to register the vehicles without assigning any reasons, while considering the fact;
(a) All the two-wheeler vehicles were sold in the month of March 2020 confirming with the mandate "no new motor vehicle conforming to the emission standard Bharat Stage -IV shall be sold or registered in the entire country with effect from 1.4.2020.
(b) On account of lockdown with effect from 23.3.2020 due to COVID pandemic, documents relating to vehicles in question were presented before respondent No. 4, when situation was little relaxed for registration of vehicles but the said authority refused to accept the document and subsequent visits also fetched no result, in fact the representation submitted before the authorities is still awaiting response.
(ii) To hold and declare that non-registration of BS-IV vehicles sold in the month of March 2020 by the registering authority is illegal, arbitrary and unjustified.
(iii) For direction upon respondent No. 3 to consider the representation of the petitioner and register the vehicles by passing an appropriate order in the pending representations of the petitioners which is pending since long but no order has been passed till date.
3. It is the grievance of the petitioner that the vehicles, which the petitioner had sold, are not being registered.
4. After going through the petition, especially the detailed chart mentioned at pages 8 to 16, I find that none of the vehicles which the petitioner is seeking to get registered, were sold by the petitioner as a dealer.
5. Further, the persons, who had purchased those vehicles, are also not before this Court.
6. Thus, in my opinion, it cannot be said that the petitioner is an aggrieved party to maintain this writ petition, as he has got no locus standi. This writ petition is dismissed on this score alone.
7. If any of the purchaser comes to this Court seeking relief, it can be considered.
