RANCHI, India, Jan. 24 -- Jharkhand High Court issued the following order on Dec. 23:
1. In this writ petition, the petitioner has prayed for grant of 2 nd and 3rd MACP, which is payable after completion of 20 years and 30 years of service respectively, whereas the petitioner has already completed 32 years of service. He further prays for re-fixation of monthly service by adding the benefits of 2nd and 3rd MACP along with entire arrears, which is due since 1995 and 2005 respectively.
2. Heard learned counsel representing the petitioner and learned counsel representing the respondents.
3. Learned counsel representing the petitioner submits that the petitioner is entitled for the benefit of 2nd and 3rd MACP, as he became eligible for the same in the year 2018 itself before his retirement from service. He submits that suffice it would be if the representation of the petitioner is directed to be considered by the respondents, so that the benefits of 2nd and 3rd MACP can be extended to the petitioner.
4. Considering the aforesaid submission, I direct the petitioner to file a fresh representation annexing all the documents, before respondent No.3 - The Superintendent Divisional Jail, Ghaghidih, Jamshedpur, within four weeks.
5. On receipt of such representation, the respondent No.3, will consider the representation of the petitioner and pass a reasoned order, within six weeks.
6. If the petitioner is found entitled for any benefit, the same should be extended to him within two weeks thereafter.
7. If any part of the claim / representation is rejected for any reason, a detailed speaking order should be communicated to the petitioner.
8. With the aforesaid directions, this writ petition stands disposed of.
