RANCHI, India, April 18 -- Jharkhand High Court issued the following order on March 17:

Pursuant to the order dated 12.03.2026 Mr. Dilip Kumar, Investigating Officer of Danda P.S. Case No. 35 of 2025 is physically present.

He has submitted that the case diary has been updated and he has also apologized for not completing the case diary and he has undertaken that in future such mistake shall not be committed.

In view of such undertaking the physical appearance of the Investigating Officer of Danda P.S. Case No. 35 of 2025 is dispensed with.

Heard the learned counsel for the respective sides.

This appeal is directed against the order dated 20.01.2026 passed by the learned Sessions Judge, Garhwa in B.P. No. 04 of 2026 arising out of Danda P.S. Case No. 35/2025, whereby and whereunder, the prayer for bail of the appellant has been rejected.

It has been alleged that the child of the informant was sold for an amount of Rs. 3.50 Lakhs to the present appellant as well as the co-accused persons.

Submission has been advanced by the learned counsel for the appellant that the appellant is a stranger and she has been falsely implicated. It has been submitted that the appellant is in custody since 15.12.2025 and charge sheet has been submitted by the police. Learned counsel adds that the child has been recovered from the custody of Urmila Devi and Rimi Devi.

Learned APP has opposed the prayer for bail of the appellant.

Regard being had to the period of custody undergone by the appellant and the fact that charge sheet has been submitted and the child has been recovered, we while setting aside the order dated 20.01.2026 passed by the learned Sessions Judge, Garhwa in B.P. No. 04 of 2026 arising out of Danda P.S. Case No. 35/2025, direct that the appellant be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Garhwa in connection with Danda P.S. Case No. 35/2025.

This appeal is allowed.
