RANCHI, India, Jan. 24 -- Jharkhand High Court issued the following order on Dec. 23:
1. Heard the parties.
2. Even after the superannuation, it is the grievance of the petitioner that his 2nd & 3rd ACP/MACP has not been granted.
3. Learned counsel appearing on behalf of the respondents submits that if the petitioner files a fresh representation, before the Secretary, Department of Food, Public Distribution and Consumer Affairs, Government of Jharkhandrespondent No.2, his case will be considered and an appropriate order will be passed as per law.
4. Considering the submission of the parties, I direct the petitioner to file a fresh representation within four weeks before the Secretary, Department of Food, Public Distribution and Consumer Affairs, Government of Jharkhand-respondent No.2. On receipt of the said representation, the case of the petitioner will be considered within six weeks and if it is necessary to place the case before any committee or any authority, the same should be placed during the said period.
5. If it is found that the petitioner is entitled for any benefit, the same will be granted within four weeks thereafter.
6. If any part of the claim of the petitioner is rejected, the reasons should be communicated to the petitioner within the aforesaid period.
7. With the aforesaid observations, this writ petition stands disposed of.
