RANCHI, India, Nov. 30 -- Jharkhand High Court issued the following order on Oct. 30:
1. Heard.
2. This application is filed under Section 11(6) of the Arbitration and Conciliation Act, 1996 for appointment of an Arbitrator to adjudicate the claims and disputes between the parties.
3. Even though three names have been suggested by the petitioner but, these names have not been agreed by the respondents. However, the parties are ad idem that any judicial officer residing in Jamshedpur could be appointed as an arbitrator to adjudicate the claims and disputes between the parties.
4. Accordingly, Shri Manoranjan Kavi, retired Principal District Judge, residing at 403, Crimson Oak Apartment, Vasundhara Estate, Near Irrigation Colony, NH-33, P.O. MGM Medical College, P.S. Mango, East Singhbhum at Jamshedpur-831018, is appointed as an arbitrator to adjudicate the dispute between the parties. 5. It is made clear that the learned Arbitrator shall not only decide the issues as emerging from the partnership deed but would be at liberty to decide all the issues that may be brought before him.
6. Learned Arbitrator would be free to lay down fees and other expenses towards conduct of the arbitration proceedings, however, keeping into account the ceiling prescribed under Schedule IV of the Act of 1996 as amended.
7. Learned Arbitrator would endeavor to conclude the proceedings expeditiously, also taking into regard the mandate of the Legislature under Section 29-A of the Act of 1996.
8. Accordingly, this application is allowed. Pending Application, if any, stands disposed of.
9. The Registry is directed to intimate the learned Arbitrator so appointed to take up the arbitration proceeding and send photocopy of the entire pleadings along with copy of the entire order sheets to the learned Arbitrator.
