RANCHI, India, May 29 -- Jharkhand High Court issued the following order on April 29:
1. Heard, the learned counsel for the parties.
2. After going through the record and hearing the parties, I find that notices have been issued under Section 3(1) & 6(2) of the Jharkhand Public Land Encroachment Act, 1956 to the petitioner, which are at Annexures-5 and 6 of the writ petition.
3. The respondent initiated a land encroachment case being Land Encroachment Case No. 01 of 2025-2026 against the petitioner and the notices have been issued.
4. The petitioner has taken several points in this writ petition challenging the said notices including the area covered under the said notices and alleged encroachment.
5. On query, learned counsel appearing on behalf of the petitioner submits that the petitioner has already appeared in the Land Encroachment Case No. 01 of 2025-2026, pursuant to the said notices.
6. When the petitioner has already appeared before the designated Officer under the Land Encroachment Act, the petitioner should file a detailed reply. Once the petitioner files a reply within three weeks from today, the case of the petitioner will be considered and the proceedings will proceed as per the Jharkhand Public Land Encroachment Act.
7. It is expected that the Collector under the said Act will consider the documents on record and defence of the petitioner and thereafter will pass an appropriate order without being prejudiced by this order.
8. Accordingly, this writ petition stands disposed of.
