RANCHI, India, May 29 -- Jharkhand High Court issued the following order on April 29:

1. Learned counsel for the petitioner seeks leave to withdraw this petition with liberty to appeal the impugned order before the Appellate Authority.

2. Leave is granted with liberty as prayed for.

3. The learned counsel for the petitioner states that an appeal will be filed within two weeks from today.

4. If the appeal is indeed filed within two weeks from today after complying with all described requirements including the requirement of pre-deposit, then, the Appellate Authority should decide this appeal on merits, without adverting to the issue of limitation.

5. All contentions of all parties on merits are, however, left open.

6. This petition is disposed of with liberty in the above terms and no costs.
