RANCHI, India, Dec. 17 -- Jharkhand High Court issued the following order on Nov. 17:
1. Heard the parties.
2. By filing this writ petition, the petitioners are claiming officiating allowance, as it is their case that they were officiating as Assistant Engineer, but they have not been granted the monetary benefit for the period which they were officiating as Assistant Engineer.
3. Learned counsel for the respondent submit that if the petitioners individually approach the authority with necessary documents, their cases can be considered and appropriate order will be passed.
4. Considering the submissions made above, the petitioners are directed to file their individual representation claiming the benefit of officiating allowance before respondent No. 3 i.e. the Secretary, Water Resources Department, Govt. of Jharkhand, within a period of three weeks from today. On receipt of the said representation, the Secretary will consider the legal entitlement of the petitioners and pass a reasoned order on the representation. If it is found that the petitioners are entitled to get any benefit the same shall be extended to them. If it is held that the petitioners are not entitled for the benefit, a reasoned order to that effect indicating the reason of such denial should be communicated to them.
5. The entire process should be concluded within a period of twelve weeks from the date of receipt of the representation.
6. With the aforesaid observation and direction, this writ petition stands disposed of.
