RANCHI, India, March 10 -- Jharkhand High Court issued the following order on Feb. 9:
1. Heard the parties.
2. The petitioner claims that she is the mother of the deceased-employee, namely, Late Takenarayan Kumar and after his death, the petitioner is entitled to get the retiral benefits. She also prays that daughter of this petitioner may be considered for compassionate appointment.
3. Learned counsel appearing on behalf of the Central Coalfields Limited submits that there is rival claim as one lady, namely, Pushpa Kumari, claimed herself is the wife of deceased-Late Takenarayan Kumar and is claiming the similar benefits. If the petitioner appears before the respondents with all the documents, the respondents will scrutinize the claim of both the parties.
4. Considering the said submission, I direct the petitioner to approach the Respondent- The General Manager (P and IR), Central Coalfields Limited who after hearing all the parties concerned will take a final decision in respect of payment of retiral benefits and compassionate appointment and will ensure payment of the same to the legal heirs.
5. It is expected that the entire process should be concluded within six months from the date of receipt of a copy of this order wherein all the parties should cooperate.
6. It is made clear if any of the parties does not cooperate in the said process, the respondent -The General Manager (P and IR), Central Coalfields Limited will at a liberty to pass an appropriate order based on the record of the case.
7. With the aforesaid observations, this writ petition is disposed of.
