RANCHI, India, Sept. 24 -- Jharkhand High Court issued the following order on Aug. 25:

Heard the learned counsel for the respective sides.

This appeal is directed against the order dated 16.07.2025 passed in M.C.A. No. 1239 of 2025 arising out of Nimiyaghat P.S. Case No. 24/2019 by the learned Additional Sessions Judge-I, Giridih, whereby and whereunder, the prayer for bail of the appellants has been rejected.

Submission has been advanced by the learned counsel for the appellants that though the appellants have been named in the First Information Report, but the same is merely on the basis of suspicion. It has been submitted that the appellants are in custody since 23.06.2025 and one of the similarly situated co-accused, namely, Faljit Mahto has been granted bail by this Court in Criminal Appeal (DB) No. 910 of 2025.

Learned PP has opposed the prayer for bail of the appellants.

On consideration of the manner of implication of the appellants and the fact that one of the co-accused has been bail by us as noted above, we while setting aside the order dated 16.07.2025 passed in M.C.A. No. 1239 of 2025 arising out of Nimiyaghat P.S. Case No. 24/2019 by the learned Additional Sessions Judge-I, Giridih, direct that the appellants be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Giridih in connection with Nimiyaghat P.S. Case No. 24/2019.

This appeal is allowed.
