RANCHI, India, April 24 -- Jharkhand High Court issued the following order on March 24:
1. Heard the learned counsel for the petitioner, learned counsel for the State and learned counsel for the respondent-JSSC.
2. It is the grievance of the petitioner that the petitioner in her category i.e. Scheduled Caste has obtained 230 marks whereas the last selected candidate has obtained 151 marks but yet her case has not been considered by the respondent-JSSC.
3. Mr. Piprawall learned counsel for the respondent-JSSC submits that the petitioner should approach the respondent No.3-Secretary, Jharkhand Staff Selection Commission along with the scoresheet of the petitioner and other documents and if it is found that the petitioner has obtained more marks than the last selected candidate in the category of the petitioner, appropriate order would be passed.
4. Considering the said submission, I direct the petitioner to file a fresh representation annexing all the documents, before the respondent No.3- Secretary, Jharkhand Staff Selection Commission within four weeks.
5. On receipt of such representation, the respondent No.3 will consider the representation of the petitioner and pass a reasoned order within six weeks.
6. If the petitioner is found entitled, the appointment letter should be issued, if there is no other legal impediment.
7. If her representation is rejected for any reason, a detailed speaking order should be communicated to the petitioner.
8. With the aforesaid directions, this writ petition stands disposed of.
