RANCHI, India, June 4 -- Jharkhand High Court issued the following order on April 4:
1. Heard the parties.
2. The petitioner is claiming title over the land in Mouza No. 35, Sadha Marney and Bara Mouza bearing Jamabandi No. 36 (old) and 35 (new), Plot No. 01 recording mentioned in Rakha Jungle total area 60 acres in which the part of 07 acres and 70 decimals as he said that he had developed the said land for agricultural purpose and he is in possession of the same for 70 years. The petitioner also prays that his name also be recorded in the Records of Rights.
3. Occupying a land and clearing the land, and cultivating the same will not make the petitioner a title holder of the land in question. The petitioner has to establish the chain of title/ownership, which can only be adjudicated in civil suit and not in an application under Article 226 of the Constitution of India.
4. Thus, I am not inclined to entertain this writ petition. The same is dismissed with the liberty to the petitioner to approach the Civil Court for the reliefs claimed and to establish his right, title and interest on the property in question.
5.Accordingly, this writ application stands disposed of.
