RANCHI, India, May 21 -- Jharkhand High Court issued the following order on April 20:
I.A. No. 4462 of 2026
1. Heard Mr. Sanjay Kumar Pandey, learned counsel for the appellant and learned A.P.P.
2. This application has been preferred by the appellant for condoning the delay of 24 days in filing of the instant appeal.
3. Having been satisfied with the reasons assigned in the instant application, the same is allowed and the delay of 24 days in filing of this appeal is hereby condoned.
4. The aforesaid I.A. stands allowed and disposed of.
Cr. Appeal (DB) No. 434 of 2026
5. This appeal is directed against the order dated 20.01.2026 passed by the learned Sessions Judge, Garhwa in B.P. No. 24 of 2026 arising out of Danda P.S. Case No. 35 of 2025 whereby and whereunder the prayer for bail of the appellant has been rejected.

Submission has been advanced by the learned counsel for the appellant that the case of the appellant stands on similar footing to that of co-accused Dilip Kumar, who has been granted bail by this Court in Cr. Appeal (DB) No. 317 of 2026. It has also been submitted that the appellant is in custody since 15.12.2025.
7. Learned A.P.P. has opposed the prayer for bail of the appellant.

The allegation reveals the child of the informant was given to the present appellant and Dilip Kumar and subsequently the child was handed over to Urmila Devi and Rimi Devi on the assurance that they will take proper care of the child. The informant had later on come to know that the infant was sold by the present appellant, Sima Devi and Dilip Kumar for Rs. 2.5 Lakh to Urmila Devi and Rimi Devi, however, considering the fact that co-accused similarly situated has been granted bail as noted above, we, while setting aside the order dated 20.01.2026 passed by learned Sessions Judge, Garhwa in B.P. No. 24 of 2026 arising out of Danda P.S. Case No. 35 of 2025, direct that the appellant be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Garhwa in connection with Danda P.S. Case No. 35 of 2025.
9. This appeal is allowed.
