RANCHI, India, Oct. 21 -- Jharkhand High Court issued the following order on Sept. 22:
1. Heard Mr. Pratiush Lala, learned counsel for the appellants and Mr. Vineet Kumar Vashistha, learned Spl.P.P.
2. This appeal is directed against the order dated 18.08.2025 passed by learned Additional Sessions Judge-XVI, Dhanbad in connection with respective A.B.Ps in A.B.P. No.2295 of 2025 and A.B.P. No.2372 of 2025 arising out of Madhuban (Dharamabandh O.P.) P.S. Case No.01 of 2025 whereby and whereunder, the prayer for anticipatory bail of the appellants has been rejected.
3. It has been alleged that with respect to marking the land of BCCL for mining of coal, two separate groups had assembled and they went on rampage, which resulted in hurling of bombs, damaging vehicles and even the officer-in-charge of Dharmabandh P.S. had suffered injuries.
4. Submission has been advanced by learned counsel for the appellants that the allegations are general and omnibus in nature.
5. It has been submitted that in the similar circumstances, one of the coaccused, Amleshwar Rawani has been granted bail by the Co-ordinate Bench of this Court in Cr. Appeal (D.B.) No.447 of 2025.
6. Learned Spl.P.P. though has opposed the prayer for bail of the appellants but has not disputed the aforesaid facts.
7. Regarding being had to the above, we, while setting aside the order dated18.08.2025 passed by learned Additional Sessions Judge-XVI, Dhanbad in connection with respective A.B.Ps in A.B.P. No.2295 of 2025 and A.B.P. No.2372 of 2025 arising out of Madhuban (Dharamabandh O.P.) P.S. Case No.01 of 2025, direct the appellants, above named, to surrender before the learned Trial Court within a period of four weeks and on their surrender, the learned Trial Court shall release them on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate First Class, Dhanbad in connection with Madhuban (Dharamabandh O.P.) P.S. Case No.01 of 2025 subject to the conditions as laid down under Section 482(2) of the Bhartiya Nagrik Suraksha Sanhita, 2023.
8. This appeal is allowed.
