Heard Mr. Lakhan Chandra Roy, learned counsel for the appellant. None appears on behalf of the State.
This interlocutory application has been preferred by the appellant for condoning a delay of 09 days in filing the appeal.
Having been satisfied with the reasons assigned in the instant application, the same is allowed and the delay of 09 days in filing the appeal is hereby condoned.
I.A. No. 5111 of 2026 stands disposed of.
Criminal Appeal (D.B.) No. 506 of 2026
This appeal is directed against the order dated 09.02.2026 passed in M.C.A. No. 129/2026, arising out of C.I.D. P.S. Case No. 34/2025, by the learned Additional Judicial Commissioner-XVIII, Ranchi, whereby and whereunder, the prayer for bail of the appellant has been rejected.
Submission has been advanced by the learned counsel for the appellant that the appellant has been implicated on the disclosure made by the apprehended accused. It has further been submitted that the appellant is in custody since 17.01.2026 and one of the co-accused who was apprehended at the spot has been granted bail by this Court in Criminal Appeal (D.B.) No. 1596 of 2025.
Though it appears that the appellant has got criminal antecedents as would appear from the impugned order but regard being had to his manner of implication and the fact that one of the apprehended accused has been granted bail as noted above, we while setting aside the order dated 09.02.2026 passed in M.C.A. No. 129/2026, arising out of C.I.D. P.S. Case No. 34/2025, by the learned Additional Judicial Commissioner-XVIII, Ranchi, direct that the appellant be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each, to the satisfaction of learned Additional Judicial Commissioner-XVIII cum Special Judge C.I.D./A.T.S., Ranchi in connection with C.I.D. P.S. Case No. 34/2025.
This appeal stands allowed.
