RANCHI, India, Dec. 25 -- Jharkhand High Court issued the following order on Nov. 25:
1. Learned counsel appearing for the petitioner submits that by order dated 19.9.2025 the petitioner was granted provisional bail subject to the condition that the petitioner will pay Rupees One Lac by way of Bank Draft. He further submits that, however, belatedly the Bank Draft was prepared and he then submits that four weeks' time was already elapsed and in view of that, the petitioner was not able to deposit the said Bank Draft before the learned court. He next submits that the Bank Draft is in order and he is ready to hand it over to the learned counsel appearing for the complainant. On this ground, he submits that provisional bail granted to the petitioner may kindly be affirmed. He also submits that the petitioner is ready to compromise the matter with the complainant.
2. Learned counsel for the O.P.No.2/ complainant submits that if the petitioner is ready to compromise the matter, the O.P.No.2/complainant is also ready to negotiate the matter.
3. In the Court proceeding the Bank Draft of Rs.One lac has been handed over to the learned counsel for the O.P.No.2 and the learned counsel will hand over the same to the complainant/ O.P.No.2.
4. In view of above and considering that Bank Draft has been handed over and the matter is arising out of Section 138 of the Negotiable Instruments Act and both the sides are ready to compromise the matter, and as such, provisional bail granted to the petitioner by order dated 19.09.2025 is, hereby, confirmed.
5. The I.A. No. 14564 of 2025 meant for confirmation of the provisional bail is hereby disposed of.
6. It is open to the petitioner and the O.P.No.2/ complainant to file the compromise petition in the form of I.A.
