RANCHI, India, Jan. 23 -- Jharkhand High Court issued the following order on Dec. 22:
Heard Mr. Agnivesh, learned counsel for the appellant and learned A.P.P.
This appeal is directed against the order dated 02.12.2025 passed by the learned Sessions Judge, Sahibganj in B.P. No. 347/2025 in connection with Sahibganj (T) P.S. Case No. 74/2025, whereby and whereunder, the prayer for bail of the appellant has been rejected.
It has been alleged that two unknown miscreants had come to the shop of the informant and sprayed him with bullets which resulted in his death.
It appears that Manish Kumar Mandal and Luv Kumar Mandal were the persons who had committed the murder and so far as the present appellant is concerned, as submitted by the learned counsel for the appellant, he has been implicated only on the basis of suspicion and in similar circumstances one of the co-accused Chhaguri Rajak @ Chutra has been granted bail by this Court in Cr. Appeal (DB) No. 994 of 2025. Learned counsel further adds that the appellant is in custody since 02.08.2025.
Learned A.P.P. has opposed the prayer for bail of the appellant.
On consideration of the aforesaid submission, we while setting aside the order dated 02.12.2025 passed by the learned Sessions Judge, Sahibganj in B.P. No. 347/2025 in connection with Sahibganj (T) P.S. Case No. 74/2025 direct that the appellant be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate at Sahibganj.
This appeal is allowed.
