RANCHI, India, April 7 -- Jharkhand High Court issued the following order on March 9:

1. Heard the learned counsel representing the petitioner and the learned counsel representing the respondents.

2. In this writ petition, the petitioner has prayed for the following reliefs:

a. To forthwith pay the arrears of salary of the petitioner as per the order dated 08.08.2024 of the State Government [Annexure-11 read with Annexure-12 & 14/1] whereby the pay protection has been allowed to him as per the applicable rule from the date of joining his service (15.04.2013 onwards) under the Government of Jharkhand.

b. To allow the due annual increments to the petitioner from the year 2023 onwards (Annexure-15 Series & 16) and also to pay the arrears of his salary on this account.

C. To pay the appropriate interest to the petitioner over the aforesaid arrears of salary for the period of delay in making the said legitimate payment to him. d. To pay the cost of litigation.

And/Or

Pass such other writ(s)/order(s)/direction(s) that Your Lordships may deem fit and proper in the facts and the circumstances of the case.

3. It is the case of the petitioner that inspite of the decision being taken, the respondents have not given effect to the said decision depriving the petitioner.

4. Learned counsel appearing on behalf of the State submits that if the petitioner files a detailed fresh representation before the respondent no. 1-Principal Secretary, Building Construction Department, his case will be considered.

5. Considering the aforesaid submission, I direct the petitioner to file a fresh representation before the respondent no. 1-Principal Secretary, Building Construction Department who will consider the case of the petitioner.

6. The representation should be filed within four weeks and the decision should be taken within eight weeks thereafter.

7. If it is found that the petitioner is entitled for monetary benefits including the arrears the same should be paid to the petitioner within a period of two weeks thereafter.

8. With the aforesaid observation and direction, this writ petition is disposed of.
