RANCHI, India, April 7 -- Jharkhand High Court issued the following order on March 9:
1. Heard learned counsel for the parties.
2. The petitioner is a Constable in Central Industrial Security Force (C.I.S.F). The petitioner has challenged the Annexure-1 by which the petitioner has been posted at Jammu & Kashmir as Reserved Battalion. His ground is that he is suffering from 'Asthma' and he has been advised not to travel to hilly and cold areas. It is his contention that his health condition will deteriorate and he cannot function in Jammu & Kashmir. He has further contended that he has filed a representation, but the same has not even been decided.
3. Considering the prayer made by the petitioner, I am not inclined to keep this writ petition pending. I direct the petitioner to file a detailed representation before The Director General, Central Industrial Security Force (Respondent no.3) by annexing all the copies of the medical documents within three weeks from today.
4. The Director General, Central Industrial Security Force (Respondent no.3) himself or any of his nominee is directed to consider the representation of the petitioner and if necessary, get the petitioner medically examined by Medical Board, and thereafter take a decision on the posting of the petitioner at Jammu & Kashmir.
5. The Director General, Central Industrial Security Force (Respondent no.3) is directed to consider the representation within a period of ten weeks' from the date of the receipt of the copy of the representation. It is expected that the petitioner will co-operate with the respondents. A reasoned order should be passed by the respondents and be communicated to the petitioner.
6. Accordingly, this writ petition is disposed of.
7. Pending I.As. if any also disposed of.
