RANCHI, India, June 28 -- Jharkhand High Court issued the following order on June 3:

1. Heard the learned counsel for the parties.

2. The petitioner has moved before this Court for grant of privilege of regular bail in connection with Bariatu P.S. Case No. 97 of 2021 instituted under Sections 414 of the Indian Penal Code along with Section 25 (1-B) a / 26 / 35 of the Arms Act.

3. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case and his name has been transpired merely on the basis of confessional statement of co-accused person namely Mohammad Wasim @ Goja. The allegation as alleged in the FIR is false and fabricated and the petitioner has not committed any offence. He further submits that the said section of Arms Act are not made out against the petitioner as the petitioner neither acquires in his possession nor carries any firearms of ammunitions. He further submits that the petitioner is languishing in judicial custody since 21.01.2025. As such, the petitioner may be enlarged on bail. He lastly submits that the petitioner is ready to abide by every condition as imposed by this Court.

4. Learned A.P.P. opposed the prayer of the petitioner for grant of bail.

5. Having regard to the facts of the case and looking into the allegation made against this petitioner, I am inclined to enlarge the petitioner on bail on furnishing bail bond of Rs. 20,000/- (Rs. Twenty Thousand Only) with two sureties of the like amount each to the satisfaction of learned J.M.F.C. - XXI, Ranchi, in connection with Bariatu P.S. Case No. 97 of 2021.

6. It is made clear that till commencement of trial the petitioner shall report to the local police station every month and after commencement of trial he shall appear on each and every date before the learned trial court and he shall not threaten any witnesses and shall co-operate in trial and if any adverse report will come against this petitioner, the learned trial court shall be at liberty to cancel the bail of this petitioner.
