RANCHI, India, Oct. 21 -- Jharkhand High Court issued the following order on Sept. 22:

1. The present writ petition has been filed for the following relief :-

"for direction upon the respondents to forthwith pay the compensation amount to the petitioner in respect of 18 decimals of land of Village - Banwari, Khata No.124, Plot No.1048, which have been acquired for extension of NH-313."

2. Counter affidavit has been filed the respondent-State. Paragraph - 6 of the counter affidavit is relevant, which is quoted herein-below :-

"6. That with regard to para no.1 of the writ petition under reply, it is humbly stated and submitted that the same relates to the prayer of the petitioner which is not liable to be granted in view of the fact that no requisition has ever been received for the acquisition of land in question and the petitioner has approached this Hon'ble Court without any rhyme or reason for getting the payment of compensation against the land which has neither been requisitioned nor been acquired and as such no further reply is required. The contents of para 1 is denied."

3. In that view of the matter, the present writ petition is, hereby, disposed of. However, the petitioner is at liberty to work out his further remedy, if any cause of action arises or survives.

4. Pending interlocutory application, if any, stands disposed of.
