RANCHI, India, June 12 -- Jharkhand High Court issued the following order on May 12:

1. Heard learned counsel for the parties.

2. The instant writ application has been preferred by the petitioner praying therein for the following reliefs: For issuance of an appropriate writ(S), order(S) or direction(S) or writ in the nature of mandamus commanding or directing upon the Respondent No 4 to consider the prayer of the petitioner to grant the monetary benefits of Senior Lecturer under Career Advancement Scheme (CAS) from date of his entitlement i.e. 17/08/2021 after promoting him to Senior Lecturer under Career Advancement Scheme (CAS), as same has not been considered though the Professor In-charge of B.N.Jalan College, Sisai, has dully forwarded his application on 23/08/2021, along with all required and requisite documents to the Ranchi University, Ranchi, for its consideration and passing an appropriate order.

AND/OR

For issuance of an appropriate writ(S), order(S) or direction(S) or writ in the nature of mandamus commanding/directing the Respondent No.5 (Jharkhand Public Service Commission) to pass an appropriate order on receipt of the recommendation if any by the Respondent-4 (The Registrar, Ranchi University, Ranchi) with respect to the promotion/monetary benefits of the post of Lecturer Senior Scale.

AND/OR

For issuance of an appropriate writ(S), order(S) or direction(S) or writ in the nature of mandamus commanding/directing the respondent authorities revised his pay-scale/pension as per his entitlement and pay the arrears of the dues arising out of grant of aforesaid benefit.

At the outset, learned counsel for the petitioner submits that the instant writ application may be disposed of by directing the respondent-University to take a decision in the matter and recommend the same to the respondent-JPSC for its approval and a timeframe may be indicated so that his case can be addressed in a better footing.

4. Learned counsel for the respective respondents fairly submits that since no counter affidavit has been filed by either of the respondents; as such, the petitioner, if so chooses to file a fresh representation, he may do so.

5. Having regard to the aforesaid submissions, the instant writ application is hereby disposed of by directing the petitioner to file a fresh representation before the respondentUniversity through its Registrar. The moment the Registrar of the respondent-University will receive the fresh representation, he shall verify the records of the case and forward the same to the respondent-JPSC and the University shall complete this exercise within a period of 12 weeks. Thereafter, the respondent-JPSC shall look into the matter and take a final decision on the grievance of the petitioner within a period of 8 weeks thereafter and if the case of the petitioner is found favorable, then proper order be issued within a further period of 2 weeks and thereafter, the petitioner be paid all consequential benefits.

6. Pending I.A., if any, also stands closed.
