RANCHI, India, June 16 -- Jharkhand High Court issued the following order on May 14:

1. Heard learned counsels for petitioner and for State.

2. The petitioner is apprehending his arrest in connection with Giridih (M) PS Case No.29 of 2026, for offence registered under section 303(2)/3(5) of BNS, 2023 and section 4, 21(A), 21(6) and 22 of Mines and Minerals (Development and Regulation) Act, 1957, Rules 4, 54 and 7 of Jharkhand Minor Minerals Concessions Rules and Rules 7 and 9 of Jharkhand Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, 2017, pending in court of learned S.D.J.M., Giridih.

3. Learned counsel for petitioner submits that the petitioner happened to be driver of the tractor and the allegation is made of carrying 100 cft sand. He next submits that the petitioner is earning his livelihood by way of driving the said vehicle and he submits that on these ground anticipatory bail to the petitioner may kindly be granted.

4. Learned State counsel opposes prayer and submits that illegally the said in question was being carried on the said vehicle.

5. Considering that the petitioner is the driver of the said vehicle and he is earning his livelihood by way of driving the said vehicle, I am inclined to grant anticipatory bail to the petitioner.

6. Accordingly, the petitioner, above named, is hereby directed to surrender before learned court within two weeks from today, and in event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to the satisfaction of learned S.D.J.M., Giridih, in connection with Giridih (M) PS Case No.29 of 2026, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
