RANCHI, India, April 7 -- Jharkhand High Court issued the following order on March 9:
1. Heard the learned counsel representing the petitioner and the learned counsel representing the respondents.
2. It is the grievance of the petitioner that family pension of the petitioner has not been finalised.
3. Learned counsel for the petitioner submits that suffice it would be if a direction is given to the respondents to consider the claim of the petitioner and pass an appropriate order and if it is found that the petitioner is entitled for the benefit the same should be disbursed to her.
4. Learned counsel appearing on behalf of the Deoghar Municipal Corporation submits that if the petitioner files a detailed fresh representation before the respondent no. 2-the Municipal Commissioner, Deoghar Municipal Corporation, her case will be considered.
5. Considering the submission of the parties, I direct the petitioner to file a fresh representation before the respondent no. 2- the Municipal Commissioner, Deoghar Municipal Corporation who will consider the case of the petitioner.
6. The representation should be filed within four weeks and the decision should be taken within six weeks thereafter.
7. If it is found that the petitioner is entitled for any monetary benefits the same should be extended to the petitioner within a period of four weeks thereafter. If the claim of the petitioner is rejected for any reasons whatsoever the reasons should be communicated to the petitioner within the aforesaid period.
8. With the aforesaid observation and direction, this writ petition is disposed of.
