RANCHI, India, April 7 -- Jharkhand High Court issued the following order on March 9:

1. The petitioners in this writ petition claims appointment to the post of "Trained Graduate Teachers" pursuant to the Advertisement No. 21 of 2016. It is a case of the petitioners that they have obtained more marks than the cut-off marks, but their case has not been considered and they have not been appointed. Thus, their candidature needs to be considered.

2. The counsel appearing on behalf of J.S.S.C., on instruction submits that all these petitioners have obtained lesser marks than the last selected candidate in the subject and the category of the petitioners.

3. Learned counsel appearing on behalf of J.S.S.C, Mr. Tejo Mistry handed over a chart showing the details of marks obtained by the petitioners and the state wise marks obtained by the last selected candidate.

4. After going through the same, I find that all the petitioners have obtained lesser marks than the last selected candidate. It is necessary to mention the category and marks obtained by the petitioners and the last selected candidate as per the chart:-

5. The chart handed over to this court by Mr. Tejo Mistry, learned counsel appearing on behalf of J.S.S.C. is kept on record.

6. On the aforesaid ground, since admittedly the petitioners have obtained lesser marks than the last selected candidate in the subject and category of the petitioners, this writ petition stands dismissed.

7. It is made clear that since the appointment process is continuing, if it is found in future that any person obtaining lesser marks than the petitioners in the category and subject of any of the petitioners has been appointed, the respective petitioner is at liberty to approach J.S.S.C. for appropriate relief.
