Heard the learned counsel for the respective parties.

This application has been preferred by the appellant for condoning a delay of 11 days in filing the appeal.

Having been satisfied with the reasons assigned in this application, the delay of 11 days which had occurred in filing this appeal is condoned and this I.A. is allowed and disposed of.

Criminal Appeal (DB) No. 746 of 2025

Heard the learned counsel for the respective sides.

This appeal is directed against the order dated 13.05.2025 passed in Misc. Criminal Application No. 828 of 2025 in connection with Piparwar P.S. Case No. 34/2024 by the learned Sessions Judge, Chatra, whereby and whereunder, the prayer for bail of the appellant has been rejected.

It has been alleged that some miscreants were apprehended by the police and from their possession various incriminating articles including firearms were recovered.

Submission has been advanced by the learned counsel for the appellant that the name of the appellant has figured on account of the confessional statement of the apprehended accused. It has been submitted that some of the co-accused have been granted bail by this Court in Criminal Appeal (DB) No. 1552 of 2024 and Criminal Appeal (DB) No. 487 of 2025. Learned counsel submits that the appellant is in custody since 28.02.2025.

Learned Spl.PP has opposed the prayer for bail of the appellant.

Regard being had to the manner of implication of the appellant, we while setting aside the order dated 13.05.2025 passed in Misc. Criminal Application No. 828 of 2025 in connection with Piparwar P.S. Case No. 34/2024 by the learned Sessions Judge, Chatra, direct that the appellant be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like mount each to the satisfaction of learned Sessions Judge, Chatra in connection with Piparwar P.S. Case No. 34/2024.

This appeal is allowed.
