JHARKHAND HIGH COURT ISSUES ORDER ON RESFUL SHEKH V/S STATE OF JHARKHAND

RANCHI, India, Jan. 24 -- Jharkhand High Court issued the following order on Dec. 23:

Heard Mr. Gautam Kumar, learned counsel for the appellant and learned Spl. P.P. for the State.

This appeal is directed against the order dated 07.11.2025 passed in B.P. No. 340 of 2025, arising out of Pakur (Mufassil) P.S. Case No. 155/2023, by the learned Additional Sessions Judge-I, Pakur, whereby and whereunder, the prayer for bail of the appellant has been rejected.

It has been alleged that while the informant was taking rest along with others the accused persons had arrived in search of him and co-accused Ajamul Shekh had thrown a bomb in the house of the informant as a result of which the informant and others have sustained injuries.

Submission has been advanced by the learned counsel for the appellant that the main allegation of throwing a bomb has been attributed to Ajamul Shekh and so far as the appellant is concerned, the allegations are general and omnibus in nature. It has further been submitted that in similar circumstances one of the coaccused namely, Lakhfor Sk @ Jahiruddin has been granted bail by a coordinate Bench of this Court in Criminal Appeal (DB) No. 311 of 2024. Learned counsel adds that the appellant is in custody since 08.08.2025.

Learned Spl. P.P. for the State has opposed the prayer for bail of the appellant.

On consideration of the fact that the main allegation is attributed to Ajamul Shekh and in similar circumstances one of the co-accused having been granted bail by a coordinate Bench of this Court as noted above, we while setting aside the order dated 07.11.2025 passed in B.P. No. 340 of 2025, arising out of Pakur (Mufassil) P.S. Case No. 155/2023, by the learned Additional Sessions Judge-I, Pakur, direct that the appellant be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each, to the satisfaction of learned S.D.J.M., Pakur in connection with Pakur (Mufassil) P.S. Case No. 155/2023.

This appeal stands allowed.
