RANCHI, India, March 28 -- Jharkhand High Court issued the following order on Feb. 24:

1. Heard the learned counsel representing the petitioners and the learned counsel representing the respondents.

2. In this writ petition, the petitioners have prayed for the following reliefs:

i. To direct the respondent authorities particularly respondent no. 5 to release the arrear amount of petitioner nos. 1 & 2 Rs. 1,84,016/- each with the statutory interest to the petitioners which is lying dues upon the respondents regarding the consolidated arrear bill of step-up since 2008-09 to 2013-14.

ii. To direct the respondent authorities particularly respondent no. 5 to release the arrear amount of petitioner no. 3 Rs. 1,77,324/- with the statutory interest to the petitioners which is lying dues upon the respondents regarding the consolidated arrear bill of step-up since 2008-09 to 2013-14. AND/OR

iii. Any other relief or reliefs be granted in favour of the petitioners as the Hon'ble Court may deem fit and proper.

3. Learned counsel for the petitioners submits that they have already filed representation and the same is yet to be considered. He submits that suffice it would be if a direction is given to the respondents to consider the representation of the petitioners.

4. Learned counsel appearing on behalf of the respondents submits that whether the petitioners are entitled to receive said amount has to be first adjudicated by the authority then only question of payment will arise. If the petitioners files a fresh detailed representation before the respondent no. 5-the District Education Officer, East Singhbhum, Jamshedpur, their case will be considered.

5. Considering the submission of the parties, I direct the petitioners to file a fresh representation along with all the annexures before the respondent no. 5-the District Education Officer, East Singhbhum, Jamshedpur who will consider the case of the petitioners.

6. The representation should be filed within six weeks and the decision should be taken within eight weeks thereafter.

7. If it is found that the petitioners are entitled for any monetary benefits the same should be extended to the petitioners within a period of two weeks thereafter. If the claim of the petitioners is rejected for any reasons whatsoever the reasons should be communicated to the petitioners within the aforesaid period.

8. With the aforesaid observation and direction, this writ petition is disposed of.
