RANCHI, India, Aug. 25 -- Jharkhand High Court issued the following order on July 25:
Heard Mr. Chandan Kumar, learned counsel for the appellant and Mr. Fahad Alam, learned A.P.P.
This appeal is directed against the order dated 12.06.2025 passed by the learned Additional Sessions Judge-II, Latehar in B.P. No. 240/2025 in connection with Balumath P.S. Case No. 160/2019, whereby and whereunder, the prayer for bail of the appellant has been rejected.
It has been alleged that on an information that the members of an extremist organization were threatening the businessmen for collection of levy, some of the extremists were apprehended by the Police and several incriminating articles were recovered from them.
Submission has been advanced by the learned counsel for the appellant that so far as the appellant is concerned, he has been implicated on the confessional statement of co-accused Mahavir Ganjhu. It has been submitted that several co-accused persons have been granted bail by a Co-ordinate Bench of this Court in Cr. Appeal (DB) No. 162 of 2024, Cr. Appeal (DB) No. 2228 of 2023 and Cr. Appeal (DB) No. 1219 of 2023. Learned counsel adds that the appellant is in custody since 28.04.2025.
Learned A.P.P. though has opposed the prayer for bail of the appellant but has not disputed the aforesaid facts.
Regard being had to the manner of implication of the appellant and the fact that several co-accused persons have been granted bail by a Co-ordinate Bench of this Court, we while setting aside the order dated 12.06.2025 passed by the learned Additional Sessions Judge-II, Latehar in B.P. No. 240/2025 in connection with Balumath P.S. Case No. 160/2019, direct that the appellant be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Latehar in connection with Balumath P.S. Case No. 160/2019.
This appeal is allowed.
