RANCHI, India, Nov. 5 -- Jharkhand High Court issued the following order on Oct. 6:
1. Heard the parties.
2. The grievance of the petitioner in this writ petition is that the benefit of the ACP has not been extended to the petitioner though he has superannuated on 31.08.2012.
3. It is the case of the petitioner that he has got all the retiral benefits and other benefits but the same needs to be recalculated after grant of ACP which the petitioner is entitled.
4. Learned counsel appearing on behalf of the Jharkhand Mineral Area Development Authority (JMADA) also admits that ACP has not been given to the petitioner.
5. Considering the said submission, I direct the respondents to consider the case of the petitioner for grant of ACP. If it is found that the petitioner is entitled for the ACP benefits the same should be granted to the petitioner and his retiral benefits including other benefits should be recalculated and revised and arrears be paid to the petitioner.
6. If the case of the petitioner needs to be placed before any Committee the same must be placed before that Committee which has been constituted for grant of consideration of ACP.
7. The entire process should be completed within 12 weeks from the date of receipt of the copy of this order.
8. The petitioner is directed to bring to the notice of the respondents about this order by filing a representation.
9. If the claim of the petitioner is denied for any reasons whatsoever the reasons should be communicated to the petitioner within the aforesaid period.
10. With the aforesaid observation and direction, this writ petition is disposed of.
