RANCHI, India, July 19 -- Jharkhand High Court issued the following order on Jun 19:
1. Heard the parties.
2. This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioner apprehending his arrest in connection with Gawan P.S. Case No.11 of 2024, for offences under Sections 323, 307, 498(A), 341 and 34 IPC. The case is presently pending before the Court of learned Judicial Magistrate, 1st Class, Giridih.
3. There is an allegation that the petitioner who is the husband, has assaulted his wife and driven her out along with the children (four daughters).
4. After going through the records, I find that the injury is simple. Prima facie after going through the records, I am of the opinion that this case will not fall within the ambit of Section 307 IPC. Further, the other Sections i.e. Sections 323, 498A, 341 IPC are punishable for a maximum period of seven years or less. Thus, this case is covered by directions given by the Hon'ble Supreme Court in the case of Satender Kumar Antil vs. Central Bureau of Investigation & Another, reported in 2022 (10) SCC 51, Satender Kumar Antil vs. Central Bureau of Investigation & Another, reported in 2024 (9) SCC 198.
5. Thus, I direct the petitioner to appear before the Court concerned and file his bond, which will be accepted.
6. It is expected that till submission of the final report, the petitioner will appear before the Investigating Officer once in every fifteen days and cooperate with the investigation.
7. With the aforesaid observation, this Anticipatory Bail Application stands disposed of.
