RANCHI, India, Nov. 19 -- Jharkhand High Court issued the following order on Oct. 29:
1. Heard learned counsel appearing on behalf of Petitioner and learned counsel appearing on behalf of the State.
2. The petitioner is apprehending his arrest in connection with T. Tanger P.S. Case No. 13/25 lodged u/s 318(2)/319(2) of BNS, pending in the court of learned Judicial Magistrate 1st Class, Simdega.
3. Learned counsel appearing for the petitioner submits that both the sections, in which, the case has been registered are bailable and the petitioner has got no apprehension of arrest. Learned counsel appearing for the petitioner then submits that although both the sections are bailable, however, this anticipatory bail application has been filed in view of fact that the learned Court while rejecting the bail has made a finding that custodial interrogation of the petitioner is required.
4. Learned counsel for the State submits that both the sections are bailable.
5. In view of the above and considering that both the sections are bailable and the petitioner has got no apprehension of arrest. Merely because, it has been observed that custodial interrogation of the petitioner is required, this anticipatory bail has been filed.
6. As such, this Anticipatory Bail is disposed of with a direction to the petitioner to surrender before the learned Court, who will pass the order in accordance with law.
